Back on the 21st of January when Amazon announced that it would release its Kindle Development Kit, A/K/A KDK, we heard it would begin rolling out in limited beta this month, with a wait list of people getting access to the kit as space was available. Well, that moment has arrived, and you can now sign up to receive said KDK. Our tipster wasn’t able to get the software in hand yet, but we’ll keep on the lookout for it. Publishing different: What the tablet brings to the table
Like newspapers before them, traditional book publishers are facing the reality of the new digital world. With Apple’s much anticipated tablet expected to debut within the next few months, they’re under more pressure than ever before to “Think Different”. Moving from print to digital isn’t a smooth or easy path, despite the fact that most authors are working digitally in the first place. As early experiences with the Amazon Kindle have shown, digital tablets are not geometric or mental equivalents of the printed page.

“You’ve got to think beyond the page,” says Chuck Toporek, my editor at Addison Wesley/Pearson, “because the page no longer exists — there is no page number, or page to flip.” Book content has to adapt and flow to on-device presentation. Like the HTML revolution of the ’90s, publishers will need to rethink how their content can adapt to changes in font size, and “the page” is more driven by screen dimension and resolution than a piece of paper is. “[Interaction styles like] pinch and zoom should not hinder the user,” Toporek adds.

Publishers need to expand their ideas about how readers interact with a book. A lot of readers tend to make notes in the margins, highlight text, or dog-ear pages as they’re reading. Instead of traditional tools, readers will be using electronic equivalents. But what will the electronic equivalents be?

Adobe’s PDF system has long included mark-up features in its Acrobat product line. Acrobat users can embed notes, scribbles, and other visual elements in PDF documents, and share those marked up and edited files with others. Over the last year or two, many of these features have found their way into Mac OS X via Apple’s Preview application. For the tablet, Toporek thinks publishers need to take highlights and annotations to the next level. “An ebook doesn’t have to be a static thing that just sits on a shelf,” Toporek adds. “Imagine a scenario where the highlights and annotations I make to an ebook can be exported and shared with anyone else who has the same ebook/device.” He goes on to add, “It would be great if I could overlay your notes on top of my own so I can see what’s important to you.”

He envisions a social network of connected readers, built around technical titles. “Wikis and wikibooks never panned out [for these kinds of technical texts] because people were looking for information they could share in but often they weren’t willing or able to write it all themselves…[Authors take] great care in building content for their books, investing hundreds, or often thousands of hours in building that content.” Readers might build on top of that content by annotating and commenting on text, digitally highlighting their favorite portions and creating “reader cuts” of the text.

A tablet could allow a community to build itself around a book, just like communities now build themselves around popular websites. “Reading a book doesn’t have to be a solo effort; it can be communal. Think about taking all those highlights and annotations and storing them on a community server, where readers could overlay the text with that feedback, whether its 2 or 20 or 200 other people. You could toggle that information on and off at will. You can build a community around an ebook, and that’s something you just can’t get with a print book.”

Toporek points out that ebooks shouldn’t limit themselves to static text and images. “You really have to leverage the capabilities of the device, and exploit the heck out of it,” says Toporek. “Think of where audio and video fit into an ebook. You can incorporate screencasts and audio clips from the author, or even include content that doesn’t make it into the print version, sort of like a director’s cut of a DVD.” According to Toporek, tablet-based books might incorporate live examples, demonstrating principles in action, just like web pages currently do. And what if you need an ebook that isn’t for the rumored Apple tablet? “Publishers should look to delivering ebooks to WebKit-based browsers so they can leverage HTML5, CSS, and JavaScript (think web-standards), or other frameworks such as SproutCore.”

If the tablet does emphasize ebooks the way analysts expect it to, we can only hope that Apple helps show publishers The Way in a future version of the iPhone SDK, similar to Amazon’s active content Kindle development kit (KDK) announced yesterday. If the tablet succeeds in its arena, the way the iPhone has before, authors and publishers will be able to Publish Different.

In A Pre-Apple Tablet World, Instapaper + Kindle Is King

IMG_0950Everyone is awaiting Apple’s tablet device. Some people (like me) won’t shut up about it. Others (like Paul) won’t shut up about shutting up about it. And while no one is exactly certain what its main use will be, there are no shortage of signs pointing to a definite role as a new way to consume written media. And several old-school publishers seem to be tripping over themselves to get on board the device as print media continues to wither. Personally, I’m excited about the possibility of a resurgence of long-form journalism. And while I’m skeptical as to just how well any device can change our growing collective desire for faster content over better content, I hold out hope because of the way I currently use my Amazon Kindle.

The Kindle, while not the Apple Tablet, is an excellent device for doing one thing: reading. And when matched with the super-fast bookmarking service Instapaper, it’s perhaps the ultimate long-form article reader. And an update this week made it ever better.

On Monday, Instapaper creator Marco Arment announced that he had significantly upgraded Instapaper’s support for the Kindle. This update made articles saved to Instapaper and transfered over to the Kindle (either wirelessly or by USB-sync) more Kindle-like, which is to say, formatted in a way more much like periodicals are when bought on the device itself. That means that you can now use the Kindle’s buttons to more easily navigate through Instapaper articles you’ve saved to read on the device.

Previously, you had to go through a series of rather laborious clicks to reach an article, and even more to get back to the main menu of articles to pick a new one. Now, you simply use the Kindle’s stick to navigate forwards and backwards between different articles. (When you’re on a selected article you wish to read, you still use the standard “Prev Page” and “Next Page” buttons to read through them.) There’s also a new “View Sections List” to see a complete table of contents for all the articles you’ve saved to read. Arment also made a change so that only the most recent Instapaper articles are shown on your main Kindle screen, while old ones are moved to a different folder — something which stops a huge amount of clutter on your main screen if you fall behind in your reading (as I often do).

Arment notes that with this new formatting and organization, reading Instapaper articles on the Kindle is now he favorite way of consuming them, even beating his excellent iPhone app. And I have to agree. This combination of Kindle + Instapaper is a killer application for the device — and it’s available right now before the Kindle’s official support for apps (announced yesterday) is even in place. If an online article is over a few paragraphs, I now automatically use my Instapaper “Read Later” bookmarklet to save it and send it over to my Kindle for reading when I step away from my computer. And now it’s easier than ever to do that.

As I said, this use of the Kindle + Instapaper gives me hope for what Apple can deliver in terms of a reading experience with the tablet. And I see it as proof that the core concept of the tablet-as-a-reader can work. The Kindle will likely retain one big advantage: its e-ink is easier on your eyes (similar to paper) than a backlit screen (much like a computer screen), which the tablet is likely to use. But the tablet will likely offer colorful graphics and interactive elements that the Kindle can’t possibly match. Not to mention that as a touchscreen device, it will almost for sure beat the pants off of the Kindle’s button + stick navigation — just as the iPhone does.

Despite the aforementioned announcement of Kindle app support, I find it hard to imagine that the device will ever get anywhere near the type of apps an Apple tablet will likely bring with it. The Kindle is simply too slow and too well, monochrome. I suspect Amazon may change both of those things this year in direct response to not only Apple’s device, but the several other devices that will hit the market this year in time the great tablet war. But for now, the Kindle remains the way to read online content offline. At least until next week, it is the tablet king.

It’s definitely shaping up to be the year of e-book readers: the Amazon Kindle is flying off (virtual) shelves, and we’d expect the Barnes & Noble Nook to start moving at a decent clip once the kinks get worked out. But any device with an always-on 3G connection to a central server raises some privacy questions, especially when it can broadcast granular, specific data about what you’re reading — data that’s subject to a wide spectrum of privacy laws and regulations when it comes to real books and libraries, but much less so in the digital realm. We’d say it’s going to take a while for all the privacy implications of e-books to be dealt with by formal policy, but in the meantime the best solution is to be informed — which is where this handy chart from our friends at the Electronic Frontier Foundation comes in. As you’d expect, the more reading you do online, the more you can be tracked — and Google Books, the Kindle, and the Nook all log a ton of data that can be shared with law enforcement and various other third parties if required. Of course, we doubt the cops are too interested in your Twilight reading habits, but honestly, we’d rather users weren’t tracked at all. Check the full chart and more at the read link.

If there is one near universal gripe folks have with the Kindle, it’s the DRM-laden files. It’s no wonder, then, that the thing has been a lightning rod for the “information wants to be free crowd,” almost since the beginning. Sure, we’ve seen Mobipocket, .epub, and .pdf files used on the device, but if you really want to bedevil Bezos the thing to do would be to altogether circumvent the DRM from your Amazon e-books — and it looks like an Israeli hacker named Labba has done just that. For the time being, the hack, which allows you to convert your legally obtained e-books to unencrypted PDF files, is available as a Python script. We’re sure that the process will be streamlined for us civilians soon enough — let’s just hope that it happens before the hole gets plugged and your e-reader auto-updated. This is one way to keep hold of your legally purchased Orwell, eh?

book“So that’s your advice is it? As my agent? On the week my book comes out in paperback, I should produce my own pirated version and give it away free? Why don’t I just punch my publisher in the face? That would be less work.”

My agent rocked back in his chair (a chair bought with 15% of my earnings) and laughed. “I didn’t say it was my advice, I just said there’s nothing they can do to stop you.”

Before our meeting had taken its subversive turn, we had been talking about ebooks: a subject that’s on every publisher and agent’s mind this week after the decision by Stephen R. Covey, author of The Seven Habits of Highly Effective People, to make his books available exclusively on the Amazon Kindle. Covey’s move has caused a highly effective shit-storm because he made it in direct defiance of his paymasters at Simon & Schuster who won’t see a penny from the deal.

‘Seven Habits’ was originally contracted back in the pre-ebook days of 1989 and as such Covey claims that the electronic rights remain with him to do with as he wishes. Simon & Schuster, perhaps unsurprisingly given that they sold 136,000 paperback copies of the book this year, disagree – arguing that Covey’s contract precludes him from publishing any ‘competing works’. “Our position is that electronic editions of our backlist titles belong in the Simon & Schuster catalog, and we intend to protect our interests in those publications.” said an S&S spokesman, ineffectively.

It’s no huge coincidence that Covey’s decision came just a few days after Simon & Schuster, along with several other publishers, announced that they were postponing the ebook release of dozens of titles on the basis that Amazon’s $9.99 price point for electronic titles was cannibalizing hardback sales. Hardback sales – especially of popular titles – are one of the cash cows of publishing, costing just a few cents more to produce and distribute than paperbacks but with a far higher cover price. Ebooks on the other hand sell for less than paperbacks but, by and large, pay a larger royalty to authors: somewhere in the region of 25% of the cover price, leaving even less profit for the publisher. The hardcore book buyers who regularly buy hardback books are also the ones most likely to have an e-reader – meaning that delaying ebook releases should result in more hardback sales. Or so goes the publishers’ logic.

The problem is that book sales are not a zero sum game. Your average Kindle owner, on discovering that a new release is not available electronically, is unlikely to set down his expensive gadget and drive down to Borders to buy the hardback. Instead he’ll simply choose a different title from the hundreds of thousands that are available. Hardcore fans of a particular author might still insist on the hardback, but they would anyway given that it’s much harder to get an ebook signed by their hero.

Meantime, as ebooks become an increasingly important distribution channel for books, authors who aren’t convinced by their publisher’s digital strategy won’t hesitate to take matters into their own hands. New authors will simply choose a different publisher, while veterans like Covey will try to exploit loopholes in their existing contracts to maximise ebook returns.

For Covey, the problem with Simon & Schuster’s digital strategy seems to be largely financial. The company that he has chosen to publish his new Kindle edition – Rosetta Books – has made a big play of the fact that they’re paying him a significantly higher royalty on sales than he was previously making on ebooks. Meanwhile Amazon has promised a huge site-wide promotional campaign for the titles. Other authors choose a publisher because their digital strategy reflects their principles. Cory Doctorow publishes many of his books with Tor Books because they agree to allow him to give away the electronic versions of his books, on the day of publication, without DRM protection. By contrast, when Apple refused to distribute the audio book of his ‘Makers‘ anthology in the iTunes store without DRM, Doctorow walked away from the deal rather than compromise his principles.

I can’t fault my publisher on money: Weidenfeld & Nicolson has paid me not one, but two generous advances to write books about myself, and I’m certain I’ve cost them the same again in lawyers’ fees thanks to the legal threats I seem to attract prior to publication. I earn a decent royalty on ebook sales in the UK and Europe and, because I still own the US rights to my books, I was free to produce my own Kindle edition – limited to US customers – and take 100% of the profits. Equally, I can’t fault W&N on supporting my principles: largely because I don’t have any.

No, the reason I found myself in my agent’s office earlier this week bitching about my publisher’s digital strategy was something even stronger than money and principle: my monstrous ego.

Since moving to the US and started to write for TechCrunch, I now have more people reading my words each week in North America than I do in the UK. Every week I delight in annoying commenters by promoting my war-of-the-worlds-winning book, to the point where people seem genuinely upset when I miss an opportunity to do so. And yet barely a day goes by without someone telling me they tried to find my book in the US, only to be disappointed that – due to publishing’s ridiculous obsession with territories – it’s only available outside North America. “It’s available on the Kindle” I say. “Pft” they reply, “I don’t have a Kindle”. In most cases I end up emailing them a PDF – a distribution model that doesn’t really scale.

The logical solution would be to publish the PDF on my site. The print version of the book has been available for 18 months now – it’s had plenty of time on bookstore shelves and with the publication of the paperback in the UK and no US publisher on the horizon, any future sales are just part of the long tail. There’s already a pirated version available on Limewire – that’s where I got the PDF from in the first place – and the more time that passes, the easier it will be to find an unauthorised digital copy.

By releasing the ebook myself for free at this stage of its life, it would do very little damage to sales but will get my words into the hands of a whole new US audience: readers who might then seek out other things I’ve written or pay me to write new things, or buy the properly-formatted Kindle edition with clickable footnotes – or any of the other myriad benefits that Doctorow cites for wanting to give his books away free.

But that’s where W&N’s digital strategy lets me down. The company has the rights to all digital sales of the book outside North America and their parent, Hachette Livre, has decreed that they will not allow any ebooks to be distributed for free, or without DRM.  If I make the ebook of Bringing Nothing available for free in the US then there’s nothing to stop foreign readers downloading it, which would breach W&N’s contractual rights. As I explained to my agent, owning the US rights to the ebook is pointless if I can’t do anything with them without pissing off my publisher.

It was that point that he made his brilliant suggestion. The kind of suggestion that makes all those 15%s worthwhile…

“Why don’t you do it anyway?”

“What do you mean?”

“I mean, you’re allowed to publish it in the US, so why don’t you just do it? If some people in the UK or Australia download it, then so what? It’s not your fault; it’s W&N’s fault for not having a global ebook strategy. And anyway, they should be delighted at the publicity.”

They really should. So what if a few people outside the US download the free version? If they haven’t bought the book by now they almost certainly weren’t going to. And who knows, if they like the ebook they might be encouraged to buy a hard copy either for themselves or as a gift for a friend. They’re certainly more likely to pre-order the next book – which is what really matters to W&N at this point. The only question was how W&N’s legal department would feel about my agent’s advice.

“I didn’t say it was my advice, I just said there’s nothing they can do to stop you.”

Semantics. I emailed my publicist to asked her, hypothetically, what would happen if I somehow convinced a US-based publication to allow me to give away the ebook of Bringing Nothing – strictly to North American readers, of course – but with no real way to stop anyone else in the world downloading it. Her reply – after speaking to the lawyers – was brilliant: “The consensus seems to be that we can’t exactly stop you. But I’ve been asked to remind you that Hachette policy is not to offer free ebooks and all our ebooks are DRM protected. So there you are. Reminded.” Just another reason why I love my publicist.

All that remained was for me to somehow convince a sufficiently popular US site to act as a patsy for my dastardly, egotistical plan. I sent an email to TechCrunch CEO Heather Harde, setting out my case and asking if TC could be that site. I was expecting it to be a tough sell, and I was right.

“YES!” she argued.

Screen shot 2009-12-15 at 12.07.51 AM The recently released e-book reader from Barnes & Noble, the Nook, has been rooted by the community of enthusiasts at nookdevs.com. The complete instructions for hacking the device and obtaining root access are detailed on the site. The Nook went on sale in late November and aims to compete with the dominant Amazon Kindle, a device which has spurrned its own community of hackers and modifiers.

The Nook retails for $259, and is an Android-powered device with built in AT&T 3G service and WiFi, along with an e-ink screen that is found in most other readers. The instructions for rooting the device require that the device is opened up and that the SD card which stores the operating system be removed. The process seems a little too simple, almost as if the device was designed to be hacked. The storage is on a removable card, which can then be loaded in another machine where the process of acquiring root access to the operating system is carried out.

This will likely lead to DRM controls being bypassed, and a slew of homebrew projects being created based on the hardware – which might ironically help Barnes & Noble in its bid to unseat both the Kindle and Sony e-Reader.

When we first caught wind of Barnes & Noble’s Nook — a device clearly positioned to give the Amazon Kindle and Sony’s options a run for their money — we were understandably interested. As voracious readers and lovers of fresh gadgetry, a new contender on the e-reader scene is more than welcome. When we discovered that Barnes & Noble’s offering would not only feature a full color touchscreen component, but would run Google’s Android OS as well… let’s just say we were pretty much in gadget-hog-heaven. We weren’t without our reservations, mind you; the appearance of this device made for some pretty heated conversations amongst the staff over whether or not we were seeing the dawn of a truly commercially viable e-reader. Of course, for us the proof is always in the pudding, and since B&N is about to launch a full assault against the current offerings, it’s our duty to turn over a report. Is the Nook the answer to our e-reader prayers, or just a stepping stone to greener pastures? We’ve taken a long, hard look at the device — so read on for the official Engadget review.
