Psystar shuts down

After Apple’s sweeping permanent injunction, Psystar has officially ceased operations. The company’s CEO Rudy Pedraza told the Dow Jones Newswire last night that he is “shutting things down immediately.” The company has also released its eight employees, and shuttered its website last night.

The actions came after Apple’s permanent injunction against Psystar earlier this week, which gave Psystar until December 31st to stop selling its Mac clones. The clones violated Apple’s End User License Agreement for Mac OS X, which expressly forbids use of the operating system on non-Apple hardware.

This also marks the end of Psystar’s Rebel EFI software, which had been Psystar’s only viable product since early December. Many Psystar watchers doubted if Psystar would continue to sell it.

Psystar first started selling its computers in April 2008, and Apple filed a lawsuit soon after in July 2008. The company was granted a motion against Psystar to stop selling its computers, preinstalled with Mac OS X, by Judge William Alsup in November. Psystar paid Apple a $2.7 million settlement earlier this month, which included $1,337,500 in copyright infringement damages.

Psystar gets permanent injunction, legal warning from judge

Psystar gets permanent injunction, legal warning from judge

Psystar’s quixotic quest to “open” Mac OS X from the clutches of Apple has been stifled by a permanent injunction from a federal judge. The order bars the company from distributing computers with modified copies of Mac OS X, or in any way aiding or abetting anyone else to do so. Despite Psystar’s attempt to have Snow Leopard and its Rebel EFI software left out of any injunction, Judge Alsup included all future versions of Mac OS X as covered by the injunction, and warned Psystar that if it continues to sell Rebel EFI, it does so at its “own peril.”

After Apple made the switch to x86-based architecture, Psystar made waves by becoming the first company to purport to offer Mac OS X-compatible clones. After a surprisingly long four-month wait, Apple filed a lawsuit against Psystar for copyright, DCMA, trademark, and other violations. Though Psystar attempted a number of stall tactics and brazenly suggested that it was the champion of “choice” in “Mac OS X-capable hardware,” summary judgment was awarded in Apple’s favor on the copyright and DCMA issues. Psystar and Apple agreed to settle for $2.7 million and call it quits on the remaining issues, while Apple moved for a permanent injunction against Psystar on the question of copyright infringement.

Microsoft forbidden from selling Word, will probably keep selling Word

Microsoft forbidden from selling Word, will probably keep selling Word
Hey, remember that seemingly random patent case from May in which a federal jury awarded a company called i4i Ltd $200 million in patent damages against Microsoft? Things just got worse for Redmond: the judge in the case today issued a permanent injunction against sales of Word 2003, Word 2007, and any future versions of Word that can open .xml, .docx, or .docm files containing “custom XML.” Yeah, no kidding — that’s pretty much all of ‘em. At issue is i4i’s patent on a method for reading XML, and obviously Microsoft’s vowed to appeal, so expect this injunction to be stayed pending that appeal in short order — and also expect Microsoft to eventually either find a way to win or simply pay up, since there’s no way it’ll let anyone kill Word. We’ll see what happens, stay tuned.
